Beginning in February of 2006, important new changes in the law relevant to my work as an Illinois workers' comp lawyer took effect. These changes have resulted in important gains for individuals who have suffered work-related injuries. The following are the primary new conditions of the law change that may apply to your unique situation:

The Rates for Disability Have Increased
For the first time in 20 years, the compensation rates for any percentage loss of a person’s ability have increased. This is great news for my clients as the new rates better reflect the increased costs of living in today’s society.

Because of a few glitches in the lawmaking process, right now there are three different rates in effect dependent upon when your claim was filed:

July 20, 2005 thru November 15, 2005
November 16, 2005 thru January 31, 2006
February 1, 2006 and After

Medical Billing
The really important change here is that now, once you or I let the medical billing companies know a claim has been filed with the Illinois Worker’s Compensation Commission, they have to leave you alone.

Known as the medical billing amendment, this comes as a welcome relief. My clients have enough turmoil in their lives and most certainly do not need to deal with the harassment of medical billers.

Group Health Payments
Another change of major importance relates to payments by group health organizations. Before the new law went into effect, an employee’s union insurance carrier typically would not pay any medical bills if a claim were denied.

The important change in the new law says that now, once you have so much as a filed application on record, your medical expenses are going to be limited to your co-payments and deductible amounts.
